PUBLIC PROCUREMENT

The firm has developed a specific expertise in the field of public procurement. It provides advice and assistance to contracting authorities and to companies, including in judicial proceedings before the Union Courts and national courts, with regard to the implementation of the directive on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts (2004/18/EC), and to the directive coordinating the procurement procedures of entities operating in the water, energy, transport and postal services sectors (2004/17/EC). The firm also assists its clients in the submission of complaints to the European Commission and advices on the applicability of the exemptions provided for certain service contracts. It further deals with "in house" contracts, ecological procurement, public service undertakings, cross-border procurement and public-private partnerships. The firm has developed a specific expertise, among others, in the sectors of organization of fairs and exhibitions, road works and waste disposal.

In the field of public procurement the firm has provided assistance, inter alia, in several cases before the Court of Justice of the EU concerning the definition of “contracting authority” and of “body governed by public law”, as well as in the matter of “abnormally low tenders”
